Acceptance of These Terms
These Terms of Service ("Terms") govern your use of the FilioNove mobile application and related services (collectively, the "App" or "Services") provided by FilioNove Team.
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Eligibility (Age 17+)
The Services are intended for users aged 17 and older. By using the Services, you represent that you are at least 17 years old and have the legal capacity to enter into these Terms.
The Services
FilioNove helps you turn walks into memorable journeys by enabling you to plan and record walking routes, visualize journeys on a map, add photos and notes, earn badges/achievements, and view monthly summaries.
We may add, remove, or modify features at any time, and may suspend or discontinue any part of the Services.
Accounts
- Accurate information: you agree to provide accurate account information and keep it updated.
- Security: you are responsible for maintaining the confidentiality of your account and for all activity under your account.
License & Acceptable Use
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the App for your personal, non-commercial use.
- No unlawful use: do not use the Services in violation of any law or regulation.
- No abuse: do not attempt unauthorized access, disrupt the Services, or introduce malware.
- No reverse engineering: except as permitted by applicable law.
- Respect others: do not harass, abuse, or harm others.
- Content responsibility: do not upload illegal content or content that infringes rights.
Location, Safety & Responsibility
If you enable location permissions, the Services may record precise or approximate location to support route planning and route recording. You are responsible for your own safety while walking. Do not use the App in a way that distracts you or violates traffic rules.
User Content
- Ownership: you retain ownership of your route notes, route data, and photos ("User Content").
- Service operation license: you grant us a limited license to host, store, reproduce, process, and display User Content solely to operate, provide, and improve the Services, and as permitted by your settings and applicable law.
- Your responsibility: you represent you have the rights necessary to provide User Content.
Optional AI-Assisted Features (If Offered)
Some features may offer AI-assisted generation (for example, generating route highlights, captions, summaries, or organizing photo collections) only when you explicitly choose to use them.
- You control uploads: you choose whether to upload text/photos for a generation request.
- Our servers: processing occurs on FilioNove Team’s own servers.
- No third-party AI processing: we do not share your uploaded text or images with third parties for AI processing.
- Prompt deletion: processing copies are deleted promptly after completion (unless you choose to save outputs).
Privacy
Our collection and use of personal information is described in our Privacy Policy. By using the Services, you consent to the collection and use of information as described there.
Intellectual Property
The Services (excluding User Content) are owned by FilioNove Team or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, sell, lease, or create derivative works from the Services except as permitted by these Terms.
Feedback
If you submit feedback or suggestions, you grant us the right to use them without restriction or compensation.
Termination
You may stop using the Services at any time. We may suspend or terminate access if we reasonably believe you violated these Terms, created risk, or used the Services unlawfully, or for maintenance or security reasons.
Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Route measurements, maps, and summaries may be approximate.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FILIONOVE TEAM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
To the maximum extent permitted by law, FilioNove Team’s total liability will not exceed the amount you paid (if any) in the 12 months before the event giving rise to the claim.
Disputes; Arbitration; Governing Law
These Terms are governed by the laws of the jurisdiction where FilioNove Team is primarily established, excluding conflict-of-law rules.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding arbitration, rather than in court, except that either party may seek injunctive or equitable relief for misuse of intellectual property or unauthorized access.
Changes to These Terms
We may update these Terms from time to time. We will revise the “Effective Date” above when changes take effect. Continued use after the effective date of updated Terms means you accept the updated Terms.
App Store (Apple) Additional Terms
- Parties: these Terms are between you and FilioNove Team, not Apple.
- Support: Apple has no obligation to provide maintenance or support for the App.
- Claims: Apple is not responsible for addressing claims relating to the App, including product liability and compliance claims.
- Refunds: if the App fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any).
- Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries and may enforce these Terms.
